We at Peek Travel, Inc. (“Peek,” “we,” “us,” “our”) know that our users (“you,” “your”) care about how your Personal Information is processed, and we take your privacy seriously. Please read the following to learn more about our data privacy practice (“Privacy Policy”). By visiting or using our website at peek.com (“Website”) or services provided through a merchant (“Services”) in any manner, you acknowledge that you accept our practices and policies outlined in this Privacy Policy, and you hereby consent that we process your Personal Information as described in this Privacy Policy. Any capitalized terms used herein without definition have the meaning given to them in the Peek Terms and Conditions.

I. WHAT DOES THIS PRIVACY POLICY COVER?
This Privacy Policy covers our processing of personally identifiable information (“Personal Information”) that we process when you are accessing or using our Website or Services. This Privacy Policy does not apply to the practices of companies that we do not own or control, including but not limited to individual merchants, or to individuals that we do not employ or manage. Also, the term “Personal Information” does not apply to information which does not relate to an identified or identifiable individual or to personal information or data rendered anonymous in such a manner that the individual is not or no longer identifiable, (“Anonymized Information”). We may use Anonymized Information for our own purposes in any manner and without attribution or compensation to any person.
We do not knowingly process Personal Information from anyone under the age of 13 or knowingly allow such persons to register for the Services (as that term is defined in our Terms and Conditions). If you are under 13, please do not attempt to register for the Services or send any information about yourself to us, including your name, address, telephone number, or email address. No one under age 13 may provide any Personal Information to us or on the Services. In the event that we learn that we have processed Personal Information from a child under age 13 without verification of parental consent, we will delete that information as quickly as possible. II. LAWFUL BASIS FOR PROCESSING PERSONAL INFORMATION
Many jurisdictions require that we disclose to you the lawful basis for our processing of your Personal Information. We do that throughout this Privacy Policy. In general, our lawful basis for processing your Personal Information is based on your specific consent or your contract with us.
By accessing or using any of the Website or Services or by otherwise interacting with us online, you consent to our processing of your Personal Information as described in this Privacy Policy. If our processing of your Personal Information is based on your consent, you may withdraw your consent at any time, and we will cease processing your Personal Information. However, in some cases, this may result in your inability to receive partial or full access to the Website or Services, and your withdrawal of consent does not limit our ability to process Anonymized Information for use by us in connection with our legitimate business efforts in the future. In that case, our processing of your Personal Information is based on the contract, so your withdrawal of consent will only be effective after the purposes for processing that Personal Information have been fulfilled and after we no longer have a legal obligation to keep that Personal Information.
In all cases, we will comply with applicable law and we will cease processing your Personal Information after the legal right, obligation, or other lawful basis expires.
III. WHAT INFORMATION DOES PEEK PROCESS?
We process various types of Personal Information, as explained more fully below. We may process this Personal Information to personalize and improve our Services, to allow you to set up a user account and profile, to contact you, to fulfill your requests for certain products and Services, to analyze how users utilize the Website, and as otherwise set forth in this Privacy Policy. We may share certain types of Personal Information with third parties (described in this Section and in Section III below). Generally, we process the following types of information:
A. Information You Provide to Us:
We process any Personal Information you knowingly provide to us. For example, we process Personal Information such as your name, email address, phone number, browser information, travel preferences, ticket purchases, and third-party account credentials (for example, your log-in credentials for Facebook or other third party sites). If you provide your third-party account credentials to us, you understand some content or information in those accounts (“Third Party Account Information”) may be transmitted into your account with us if you authorize such transmissions, that Third Party Account Information transmitted to our Website is covered by this Privacy Policy, and that we will process such information. You can choose not to provide us with certain information, but then you may not be able to register with us or to take advantage of some of our features.
B. Information Processed Automatically:
Whenever you interact with our Website, we automatically process Personal Information on our server logs from your browser including your IP address, “cookie” information, and the page you requested. “Cookies” are identifiers we transfer to your computer or mobile device that allow us to recognize your browser or mobile device and tell us how and when pages in our Website are visited and by how many people. You may be able to change the preferences on your browser or mobile device to prevent or limit your computer or device’s acceptance of cookies, but this may prevent you from taking advantage of some of our Website’s and Services’ features. If you click on a link to a third-party website, such third party may also transmit cookies to you. This Privacy Policy does not cover the use of cookies by any third parties. We may also share this Personal Information to our partners for advertising and analytical purposes and such partners may deliver advertisements to you. If you choose to opt out of us sharing your Personal Information for advertising purposes, you may change your cookie preferences on your device or opt out by filling out a form at this link.
When we process usage information (such as the numbers and frequency of visitors to the Website), we may process this data as Anonymized Information. For example, this Anonymized Information tells us how often users use parts of the Website, so that we can make the Website appealing to as many users as possible. We may also provide this Anonymized Information to our partners; our partners may use such information to understand how often and in what ways people use our Website, so that they, too, can provide you with an optimal experience.

IV. WILL PEEK SHARE ANY OF THE PERSONAL INFORMATION IT PROCESSES?
We do not sell your Personal Information. We share your Personal Information with third parties as described below.
A. Affiliated Businesses and Third-Party Websites We Do Not Control:
In certain situations, businesses or third-party websites we’re affiliated with, including merchants, may sell items or provide services to you through the Website (either alone or jointly with us). You can recognize when an affiliated business is associated with such a transaction or service, and we will share your Personal Information with that affiliated business only to the extent that it is related to such transaction or service. For example, we may need to share certain information about you with a merchant, so that merchant can allow you to use your ticket at its place of business. Another such transaction or service may include the ability for you to automatically transmit Third Party Account Information to your Website profile or to automatically transmit information in your Website profile to your third-party account. We have no control over the policies and practices of third-party websites or businesses as to data privacy or anything else, so if you choose to take part in any transaction or service relating to an affiliated website or business, please review all such business’ or websites’ policies.
B. Service Providers:
We employ other companies and people to perform tasks on our behalf and need to share your information with them to provide products or services to you. Unless we tell you differently, our service providers do not have any right to use the Personal Information we share with them beyond what is necessary to assist us.
C. User Profiles and Submissions:
Certain user profile information, including without limitation a user’s name, location, and any video or image content that such user has uploaded to the Website or Services, may be displayed to other users to facilitate user interaction within the Website and Services or address your request for Peek’s Services. Your account privacy settings may allow you to limit the other users who can see the Personal Information in your user profile or what information in your user profile is visible to others. Any content you upload to your public user profile, along with any Personal Information or content that you voluntarily disclose online in a manner other users can view (on discussion boards, in messages and chat areas, etc.) becomes publicly available, and can be processed and used by others. Your username may also be displayed to other users if and when you send messages or comments or upload images or videos through the Website and other users can contact you through messages and comments. Additionally, if you sign into the Website through a third-party social networking site or service, your list of “friends” from that site or service may be automatically imported to the Website, and such “friends,” if they are also registered users of the Website, may be able to access certain non-public information you have entered in your Website user profile. Again, we do not control the policies and practices of any other third-party site or service.
D. Business Transfers:
We may choose to buy or sell assets. In these types of transactions, customer information is typically one of the business assets that would be transferred. Also, if we (or substantially all of our assets) are acquired, or if we go out of business, enter bankruptcy, or go through some other change of control, Personal Information would be one of the assets transferred to or acquired by a third party.
E. Protection of Peek and Others:
We reserve the right to process any information that we reasonably believe is necessary to comply with law or court order; enforce or apply our conditions of use and other agreements; or protect the rights, property, or safety of Peek, our employees, our users, or others. This includes exchanging information with other companies and organizations for fraud protection and credit risk reduction.
F. Advertising Purposes:
We may share your Personal Information with partners and service providers for advertising and marketing purposes. These third parties may process your Personal Information to send you advertisements based on your interactions with us. If you choose to opt out of us sharing your Personal Information for advertising purposes, you may change your cookie preferences on your device or opt out by filling out a form at this link.
G. With Your Consent:
Except as set forth above, you will be notified when your Personal Information may be shared with third parties, and will be able to prevent the sharing of this information.
V. IS PERSONAL INFORMATION ABOUT ME SECURE?
Your account is protected by a password for your privacy and security. If you access your account via a third-party site or service, you may have additional or different sign-on protections via that third-party site or service. You must prevent unauthorized access to your account and Personal Information by selecting and protecting your password or other sign-on mechanism appropriately and limiting access to your computer or device and browser by signing off after you have finished accessing your account.
We endeavor to protect the privacy of your account and other Personal Information we hold in our records, but we cannot guarantee complete security. Unauthorized entry or use, hardware or software failure, and other factors, may compromise the security of user information at any time.

VI. WHAT PERSONAL INFORMATION CAN I ACCESS?
Through your account settings, you may access, and, in some cases, edit or delete the following information you’ve provided to us:

Further, although we currently do not process Personal Information without consent, if we at any time in the future process Personal Information without your express consent, you may opt-out or withdraw consent at any time.

We will try to comply with your request(s) as soon as reasonably practicable. Upon receipt of your written request, we will provide you with a copy of your information, although in certain limited circumstances we may not be able to make all relevant information available to you, such as where that information also pertains to another user. In such circumstances we will provide reasons for the denial to you upon request.

A. Privacy for EU/UK Residents
The Regulation (EU) 2016/679 (General Data Protection Regulation) made effective in the European Union on May 25, 2018 (“GDPR”) requires that we clearly describe to data subjects the data we process and how we process that data. We are based in the United States. By accessing or using the Services or otherwise providing information to us, you understand that your information will be subject to processing, transfer, and storage in and to the United States.
Due to the nature of our Services, we typically act as a “Processor” as defined under the GDPR. If you believe that this role should be defined differently, please contact us at trust@peek.com.
Pursuant to the GDPR, residents of Europe have the right to obtain our confirmation of whether we maintain personal information relating to them in the United States. If you are a resident of the EU, upon request from you, we will provide you with access to the Personal Information that we hold about you. Please contact us if you have any questions.
Further, if you are a resident of the United Kingdom (“UK”), to the extent the GDPR as incorporated into UK law pursuant to s.3 of the European Union (Withdrawal Act) 2018 (as amended, the “UK GDPR”) is different than the GDPR, we will follow all supplemental requirements under the UK GDPR and you have all rights as a UK citizen under the UK GDPR.
B. Privacy for California Residents
California adopted the California Consumer Privacy Act (“CCPA”), which took effect at the beginning of 2020 and the California Privacy Rights Act (“CPRA”), which fully took effect January 1, 2022. We comply with the requirements of the CCPA and CPRA to the extent they apply to us.
If you are a California resident, you may request to exercise your rights for any Personal Information we have processed in the 12 months prior to your request. Such request covers any categories, sources, purposes, and, if applicable, third parties to whom we share the Personal Information. Further, you can exercise any of your rights free of discrimination, for example, we cannot increase the price of the Services or decrease the quality of the Services because you exercise your rights.

D. “Do Not Track” Options
Your web browser(s) may offer a “Do Not Track” option, which allows the individual to signal to operators of websites and web applications and services (including behavioral advertising services) that he or she does not wish such operators to track certain of his or her online activities over time and across different websites. We do our best to support Do Not Track requests but cannot guarantee full support based on the variety of internet browsers and technologies which means that we may process information about your online activity both while you are using the Website or Services and after your use of the Website or Services.
VIII. CHANGES TO THIS PRIVACY POLICY
We may amend this Privacy Policy from time to time. Use of information we process now is subject to the Privacy Policy in effect at the time such information is processed.
